Terms of Sale
Scope and validity of the terms
- These terms apply to the legal relationships between the buyer and PYRO1 OÜ, the owner of the fireworks online shop, arising from the purchase of products through the tulepood.ee online shop.
- In addition to these terms, the legal relationships arising from the purchase of products through the tulepood.ee online shop are governed by the legislation in force in the Republic of Estonia.
- Reading the terms is mandatory.
- PYRO1 OÜ is entitled to amend and supplement these terms and the price list in line with the development of the tulepood.ee online shop and in the interests of better and safer use of the online shop.
- Amendments and additions to the terms and the price list are announced on the website www.tulepood.ee.
- Amendments and additions to the terms and the price list enter into force upon publication of the relevant amendment or addition on the website www.tulepood.ee. If you submitted your order before the amendments to the terms entered into force, the legal relationship between you and PYRO1 OÜ is governed by the terms in force at the time you submitted the order, unless otherwise provided by law or these terms.
- PYRO1 OÜ has the right to refuse to fulfil an order if the buyer does not meet the conditions of § 41 of the Explosives Act (Lõhkematerjaliseadus).

Prices
- Prices in the www.tulepood.ee online shop are in euros and VAT-free.
- The range and prices in the Tulepood.ee online shop may differ from the range and prices in the Tulepood Ilutulestikud shop (Punane 40).
- PYRO1 OÜ – has the right to change the prices displayed in the online shop at any time.
- Prices are valid from the placing of the order until the expiry of the payment deadline of the placed order.
Making a purchase and placing an order
- If you do not meet the age restriction criteria for the products, you are prohibited from making a purchase and placing an order.
- Select the product/products and click “add to cart”.
- You can change the number of products in the shopping cart.
- Please be careful when filling in the fields on the customer details and order confirmation pages, as the fast and smooth delivery of the purchased products depends on the accuracy and correctness of this information.
- Select the delivery method.
- Select a suitable payment method.
- Confirm your agreement with, compliance with and adherence to the terms of the online shop by ticking the relevant box.
- To submit the order, click the „Confirm order” button.
- After paying for the goods, proceed from the payment method page by clicking the “RETURN TO MERCHANT” button. An order confirmation message is displayed to confirm the order and payment, and an order confirmation is sent to the e-mail address you entered.
- The sales contract for the products is deemed concluded (entry into force of the Contract) from the moment the amount payable according to the order confirmation is received in the bank account of PYRO1 OÜ.
Payment for products
- To make a payment, select your preferred payment method when placing the order.
- As of 1 September 2021, products can be paid for: via internet bank link (Swedbank, SEB, Luminor, LHV, Coop).
- PYRO1 OÜ is the controller of personal data; PYRO1 OÜ transfers the personal data necessary for making payments to the processor _______________.
- If you choose „I will pick it up myself“ as the delivery method, products can be paid for in cash, by card, by bank transfer to the bank account of PYRO1 OÜ or via bank link.
- If you choose „Courier service“ as the delivery method, products can be paid for via bank link.
- Your order will be cancelled if you have not paid the purchase amount within the prescribed time or do not collect the goods within 7 working days.
Delivery and handover of products
- The Seller starts fulfilling the order after the payment has been received in the bank account of PYRO1 OÜ.
- When receiving the goods, the Buyer is obliged to make sure and ensure that the recipient of the goods is a person who does not conflict with the conditions set out in § 33 of the Explosives Act.
- Goods are delivered to the buyer within the territory of the Republic of Estonia.
- If the buyer has chosen courier as the delivery method, the goods are delivered by courier within 1–5 working days. The maximum delivery time is 5 working days.
- If, after the conclusion of the sales transaction, it turns out that the Goods have for some reason run out of stock in the Seller’s warehouse and ordering and delivering them will take longer, the Seller will notify the Buyer within two working days and inform the Buyer of the new estimated delivery date. The Buyer has the right to withdraw from the sales contract due to the extension of the delivery period.
- Goods are delivered to the Buyer using third-party carriers: PAKK Eesti OÜ, to the delivery address provided by the customer. Orders are dispatched to the customer in accordance with the shipping terms of PAKK Eesti OÜ.
- If you have chosen “I will pick it up myself” as the delivery method, you can collect your ordered goods at Punane 40, Tallinn.
- If the order amount is 300 € or more, transport across Estonia is FREE. For smaller purchase amounts, the customer pays an additional 10€ (within Tallinn) and 14 € (across Estonia) for the courier service. Courier service to Saaremaa and Hiiumaa costs from 24€ or as agreed.
Order cancellation and product returns
- A Buyer who is a natural person has a 14-day right of return for Goods purchased from the online shop.
- The returned product must be free of defects, complete, in its original packaging and unused.
- To return goods, a return notice in free form must be sent to the e-mail pood@tulepood.ee and the goods must be returned without delay.
- Upon withdrawal from the contract, the consumer must return the purchased item without delay, but no later than within 14 days after giving notice of withdrawal from the contract.
- The costs related to the return are borne by the Buyer.
Procedure for submitting claims
- The procedure for submitting claims set out in § 218 of the Law of Obligations Act (Võlaõigusseadus) applies to the Goods. The Law of Obligations Act is available at https://www.riigiteataja.ee/akt/108072011021
- PYRO1 OÜ is not liable for:
- Physical damage to the Goods caused through the fault of the Buyer
- Defects resulting from improper use of the goods.
Personal data and its use
- The Buyer gives PYRO1 OÜ clear and informed consent to the processing of their personal data.
- The buyer’s personal data entered by the user when submitting an order and made known to the Service Provider is entered in the customer register and used to provide the sales service and to offer goods to the buyer.
- The source of personal data is the creation of a customer relationship upon registration of an order in the E-shop.
The registered personal data include data on the buyer’s order – surname, first name (first names), street, house, apartment number, settlement or city, postal code, telephone number, address, delivery method, payment method used, E-shop - Acceptance of the user agreement, comments entered as free text at the e-mail address.
- The buyer’s personal data necessary for delivering the goods to the buyer is transferred to the company providing the courier service.
- The protection of personal data is ensured with all security measures required by law.
- PYRO1 OÜ undertakes not to transfer registered personal data to third parties.
- PYRO1 OÜ reserves the right to transfer personal data concerning the buyer to persons who have a legal right to it and who process the data to fulfil an obligation prescribed by law, and to persons who have a legal right to it where this is done to protect the life, health or liberty of the buyer or another person.
- The Buyer has the right to check the personal data concerning them, as well as to change it or request the removal of their personal data from the register.
- The Buyer consents to PYRO1 OÜ sending an order confirmation to the e-mail address entered when submitting the order.
- PYRO1 OÜ is the controller of personal data; PYRO1 OÜ transfers the personal data necessary for making payments to the processor __________.
Liability and force majeure
- PYRO1 OÜ is liable to you, and you are liable to PYRO1 OÜ, for damage caused to the other party by a breach of these terms in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
- PYRO1 OÜ is not liable for damage caused to you or for a delay in the delivery of the product if the damage or delay in delivery is caused by a circumstance that PYRO1 OÜ could not influence and whose occurrence PYRO1 OÜ did not and could not foresee (force majeure).
Other terms
- Issues not specifically addressed in the terms are governed by the legislation in force in the Republic of Estonia.
- Disputes arising between you and PYRO1 OÜ in connection with ordering and purchasing products through the online shop are resolved by negotiation. If no agreement is reached, you have the right to turn to the Consumer Disputes Committee through the Consumer Protection Board (Tarbijakaitseamet) or to Harju County Court to protect your rights. The consumer may file a complaint personally or through a representative. Disputes are resolved in accordance with the legislation in force in the Republic of Estonia.
